Terms & Conditions

Accommodation Terms & Conditions:

1. Payment for accommodation bookings

1.1 When making a booking by phone, in person or online I agree to the following:
(a) To provide credit card details for a non-refundable deposit of 50% to secure the booking. Only reservations made via credit card will be accepted.
(b) For internet (online) bookings, 100% payment is due at time of booking.
(c) Balance is due 30 days prior to arrival date, and will be debited from my credit card without notification at that time.
(d) Credit card details are required to make a booking.
(e) If payment is not made in full on the due date, management has the right to cancel the booking.
(f) Full payment is required at the time of booking via credit card for bookings made within 30 days of the arrival date.

1.2 Payment of the deposit via telephone or via the internet will be taken as your acceptance of these booking terms and conditions.

2. Refunds for accommodation bookings:

2.1 When cancelling a booking I acknowledge and agree that:
(a) If I cancel within 30 days of arrival date, there is a 100% cancellation fee and no refund is due to me.
(b) If I cancel before 30 days of the arrival date, I forfeit all payments made.
(c) Changing dates of booking is considered to be a cancellation.
(d) Refunds will be due to customers in circumstances such as road closures on Mt Baw Baw Rd.
(e) No refunds are given to customers due to lack of snow or bad weather conditions.
(f) No Shows will be considered as a cancellation.
(g) Cancellations are not accepted for bookings from Wotif.com.
(h) Refunds will not be given in the event of power or water outages or such events beyond our control.

2.2 Management disclaims all responsibility and accepts no liability in respect of any errors or mis-descriptions and all associated disappointment, loss, inconvenience, expense or injury caused. Without liability, we will not be responsible if the product is not available due to civil unrest, industrial disputes, and interruptions to power supply, adverse weather conditions, health risk or terrorist activity.

2.3 Management reserves the right to charge a refundable accommodation bond of $250 for all accommodation at the time of arrival. This will be done via a pre-authorisation to your nominated credit card, or an alternative credit card to be provided at the time of check in. Upon your departure, an inspection of the premises will be conducted and the pre-authorised funds will be released back to the credit card, failure to leave the premises in a suitable, clean and tidy manner will result in a cleaning fee being charged and consequently a loss of bond. This also applies to loss or damage to accommodation keys, where a $50 fee will be charged.

2.4 Management reserves the right to request that guests ‘check out’ on the day of departure prior to the designated ‘check out’ time. Failure to ‘check out’ at the designated time will result in a $50.00 per hour late check-out fee and will be charged to the guest’s credit card.

2.5 Management reserves the right to charge for any damage, breakages or theft that occurs by you or your guests during your stay.

3. Travel Insurance:

3.1 Management strongly recommends Travel Insurance to protect you against loss of personal belongings, public liability, adverse weather conditions and cancellation fees.

4. Accommodation Occupancy Conditions:

4.1 I acknowledge and agree that the following additional conditions apply:

(a) Accommodation is to be left in a clean and tidy condition by checkout. In the event that the guest leave dishes unwashed, rubbish lying around and bathrooms unclean, a cleaning fee will be charged to the nominated credit card.
(b) All accommodation is smoke free. In the event that guests smoke or allow others to smoke, a cleaning charge of $300 shall be charged to the guests account.
(c) No pets or domestic animals of any description are allowed at the Resort. The only exception being for the all service animals.
(d) Guests occupying self-contained accommodation are required to bring sheets, pillow cases, towels, doona/blankets, tea towels, washing and personal items. Linen hire is available and must be booked and paid for prior to arrival if required.

4.2 I agree to pay and be responsible for any damage or losses caused to the bed/rooms or facility as a result of any action by myself, my guests and invites, and will immediately notify management of any such damage or loss. Failure to do so will lead to prosecution to the full extent of the law.

4.3 I agree to indemnify Alpine Resorts Victoria trading as Mt Baw Baw Alpine Resort from and against all claim, suits, actions and demands made against SARMB which arise out of the use of the apartment/cabin/lodge/hotel and its facilities by myself, my guests and invitees.

4.4 To the extent permitted by law, I also release Alpine Resorts Victoria from and against all claims, suits and actions relating to my booking and use of the accommodation and its facilities.

General Privacy and Terms

Alpine Resorts Victoria are committed to respecting your online privacy and recognise the need for appropriate protection and management of information you share with us. Sensitive personal information will not be shared with any third parties except where sharing of the information is essential in delivering to you accommodation, a product or service. Information collected will be used for the purpose of accurately fulfilling your booking including any required contact where there is an issue with the booking requested/ placed.

Credit card processorsInTouch and RMS Hospitality Solutions are the third parties we use which assist us to securely and efficiently complete your booking. These companies use your information to authorise payment and book accommodation for you. Otherwise, mountbawbaw.com.au does not sell, rent, share, or transfer your personal information to third parties. The information you give us is confidential, and will not be sold or given to any individual or company or organization.

1. General Credit Card Privacy

We do not see or store your credit card information. Your details are processed directly through our payment gateway partner, where they are encrypted using Ingrian devices to provide the highest level of protection available. Ingrian devices provide tamper-resistant protection of cryptographic keys to ensure encrypted data is kept private and secure.

2. Email Newsletter Privacy

If you would like to opt out of receiving our newsletter/email after booking with us or if you signed up to receive it while visiting our site, there is a way for you to unsubscribe from it if you no longer wish to receive it. Follow the unsubscribe instructions within the newsletter or email us.

3. Sessions and Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. Like most websites, mountbawbaw.com.au uses cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site. Our website uses session ID cookies. Session cookies make it easier for you to navigate our site. A session ID cookie expires when you close your browser. If you reject cookies, you may still use our site, but your ability to use some areas of our site will be limited.

4. Security and Privacy Collection Notice

The Board respects the privacy of your personal information and uses your personal information only in accordance with its Privacy and Data Protection Policy. The Board operates and is protected by 24 hour electronic surveillance equipment.  CCTV images may be recorded for the purposes of:

a) Crime prevention and detection;

b) Training and coaching of personnel;

c) Enhancing personal safety of the mountain’s community; and

d) Ensuring the accuracy of information gathered post an incident or event.

The IT Department collects your personal information for the primary purposes of managing safety and access to buildings. Your personal information may be disclosed to contracted service providers of the Board, law and regulatory enforcement agencies and where required or authorised by law.

You may have the right to access the personal information we hold about you subject to any exceptions in relevant laws, by contacting us on

5. Advertising and Your Data

Your data such as email addresses may be used to send out advertisements or to create advertising lists to inform you of offers and services.

School and Scout Group Cancellation Policy:

1. The standard CABS cancellation policy is not always appropriate for school groups, who are invoiced for their trip rather than paying when booking. Special additional conditions apply;
​(a) When booking, schools make an estimate of student numbers and then adjust this as their trip approaches. Schools should notify the school coordinator of any significant number changes as soon as known.

(b) Schools must provide final confirmation of student numbers 14 days in advance of trip when invoicing commences. Payment due before the trip.

(c) Any reductions in students’ numbers after this date may be charged a 100% cancellation fee for the reduction in numbers, or the minimum whole lodge booking rate as indicated by the lodge

(d) If the school cancels a trip (for non-COVID related reasons) the following fees due to lost revenue may be invoiced at the discretion of the lodge;

  • 50% cancellation fee within 21 days or less of the trip date
  • 100% cancellation fee within 14 days or less of the trip date

General Product Terms and Conditions:

1. Estore or in-person purchases

(a) Amendments – we will consider amending your booking at your request, excluding lessons or other activities which have been allocated staff or will incur a loss of income if amended, if the amendment request is sent 21 business days prior to your trip by email.

  • We do not guarantee that we can or will amend your booking – repeated calls or emails will not increase the speed at which we can respond to your request. Please send a single email and we will get in touch with you.

b) Cancellations: Any change request, no show, or failure to use product within 21 business days of booking, or on the day or booking, is considered a cancellation

  • Cancellations within 14 days of initial booking arrival date are non-refundable. The Resort may consider amendment or credit – as per sections (a) and (c) – where sessions can be rebooked without loss of income

c) Credit / refund requests after date of purchase – we will consider your refund request for reasonable circumstances but do not guarantee refund. You must submit a request via the refund request form supplied.

  • We will consider credit or refunds for all genuine medical grounds which impact your ability to travel and may ask for evidence
  • Mt Baw Baw reserves the right to issue credit for eStore and in person transactions – where credit is issued – we do not consider further requests for refund.
  • Where a refund is issued, we reserve the right to issue refund minus transaction fees and admin fees as outlined (d) below

d) Administration, loss of income and replacement

  • Mt Baw Baw reserves the right to charge a $20 administration fee for amendment requests by email and a $40 administration fee for requests made via phone, per call or request.
  • Mt Baw Baw reserves right to charge replacement fees at replacement cost for unreturned, damaged or stolen products such as but not limited to toboggans, skis, snowboards, merchandise & helmets

 

Mt Baw Baw Snow Guarantee:

Mt Baw Baw offers a Snow Guarantee in select areas utilising Snowmaking technologies from Opening Weekend (8th June 2024) to early September (8th September 2024).

1. The snow guarantee applies at minimum to the following areas: Hut Run to Tower 2 for beginner skiing and snowboarding & lessons; a section of the toboggan park; where possible an area for snow play will also be included.

2. Customers are advised to take responsibility when booking and check the cameras to see the snow conditions around the village and read snow reports for conditions on the slopes.

 

Mount Baw Baw Alpine Resort – Terms and Conditions of Entry

Term and Conditions

  1. These terms and conditions sent out the Conditions of Entry to the Resort.
  2. Definitions
    1. Alpine Resorts Victoria (ARV or Board) is the committee of management as defined in the Act.
    2. Mount Baw Baw Alpine Resort (MBBAR or Resort) is the Mount Baw Baw Alpine Resort Crown Land Reserve as designated under the Alpine Resorts Act and controlled by the Board.
    3. Supplier is ARV or MBBAR
    4. Conditions are those terms and conditions set out in this document.
    5. Permit is an authority issued by ARV or MBBAR to use an improvement, service or facility or to enter and use an area of the Resort.
    6. Permit Holder is a Visitor or Guest that has been issued with a Permit.
    7. Guest is any person who – is a Visitor to the Resort; interacts with our websites, social media accounts, booking platforms or device application; or purchases a Resort operated service or product.
    8. Act is the Alpine Resorts (Management) Act 1997
    9. Declared Snow Season is the period declared by SARMB to be the snow season for the Resort.
    10. Visitor is any person who enters the Resort.
    11. Customer is any person who purchases a product or service from the Supplier.
    12. Websites are the public facing domains, websites and platforms that provide information and services at the Resort. These
    13. Set aside areas are those areas as determined by ARV where defined activities may be undertaken, including parking, camping, aircraft landing and recreational activities.
    14. Resort Management is the individual and collective officers and staff of ARV who have responsibility for the management and operation of the Resort.
    15. Centralised Accommodation Booking Service (CABS or Booking Service) is a collective of on and off mountain independent and ARV accommodation and service providers providing a booking service for Resort based services.
    16. Resort Booking Service refers to the Resort’s accommodation (CABS) and product booking service delivered on our Websites and by our on resort Guest Information Centre (GIC) by telephone, email and in person.
    17. Recreational Activities include, but not limited to, alpine skiing, snow boarding, mountain biking, cross-country skiing, snow shoeing, trail walking, bushwalking, tobogganing, snow play, sled rides (both animal and engine powered), road cycling, trail running, trampoline, laser tag, disc golf, terrain park activities,

 

Conditions of Entry

These Conditions of Entry apply to entry to the Resort:

  1. Each visitor to the resort must comply with the following Conditions of Entry.
  2. These Conditions of Entry apply year-round.
  3. A Permit to enter the Resort is required during the Declared Snow Season. Refer Conditions of Purchase (Resort Entry) for details.
  1. At all times while in the Resort, the Visitor must comply with:
    1. the Alpine Responsibility Code (during the Declared Snow Season) which is available at mtbawbaw.com.au
    2. the Alpine Resorts (Management) Act 1997;
    3. Alpine Resorts (Management) Regulations 2020;
    4. Crown Land (Reserves) (Southern Alpine Resorts) Regulations 2020;
    5. any directive made under the Public Health and Wellbeing Act 2008 (Vic); and
    6. all signs (including during hours of darkness) or other lawful directions of the Supplier or any of its employees and agents.
  2. Visitors acknowledge and agree that some services with the Resort are operated by the Supplier and that entering the Resort does not guarantee access to those services. Refer Conditions of Purchase and Conditions of Use for further terms and conditions related to Resort operated services.
  3. Visitors acknowledge and agree that some services within the Resort are owned and operated by independent third parties and that entering the Resort does not guarantee access to those services. Those services are sold independently and separately. The Visitor releases the Supplier from any liability in relation to the availability or use of those services.
  4. Wheel chain declarations may be made at any time of the year, including days outside of the Declared Snow Season. Visitors who are in control of a motor vehicle operating within or entering the Resort are required to follow all directions and signage regarding the carrying and fitting of wheel chains for specified classes of vehicles. Fines may be issued in accordance with breaches as set out in the Alpine Resorts (Management) Regulations 2020.
  5. Visitors must park vehicles within marked bays in designated parking areas or in accordance with the directions of Resort staff or signage, and operated a vehicle in a safe manner. Parking within leased sites shall at all times be within designated driveways and parking areas. A fine may be issued to Visitors who leave vehicles in a position which causes any obstruction to walkways, roads, are not within marked bays, not within posted hours or operated in an unsafe manner. Vehicles not parked in designated areas, outside displayed times or causing an obstruction may be clamped, towed and stored; and released at the owner’s expense.
  6. Internal Village roadways are closed to wheeled vehicles during the Declared Snow Season and at other times of the year subject to road and weather conditions.
  7. The Supplier does not provide a vehicle road-side breakdown, emergency fuel or vehicle recovery service. Visitors should contact independent service providers as needed.
  8. Visitors are not permitted to bring their own food and beverages or food preparation devices (stoves, cookers) in to any registered food and beverage premises (restaurants and cafes) operated by the Resort.
  9. If the Resort is closed for one of the reasons set out in Condition 25, the Supplier will use reasonable endeavours to notify the Visitor. However, the Supplier does not guarantee that Visitors will be informed of such closure before they arrive at the Resort.
  10. As part of the State of Victoria’s response to COVID-19 the resort may be required to limit access and capacity of venues and activities, and in order to support contact tracing requirements, Visitors may be required to:
    1. provide the name and contact details of all persons entering the Resort, and
    2. check in to Resort venues using the Services Victoria app.
  11. Visitors acknowledge that the Supplier and third parties authorised by the Supplier may make or record film, photographs or other forms of moving picture, still picture or any format of them at the Resort (including, but not limited to, of Visitors and their vehicle). Each Visitor grants to the Supplier and third parties authorised by it, permission to use photographs, film, tape, or other images or likenesses of the Visitor in any media (including publication within or outside Victoria, Australia and for any purpose without identification or compensation or payment of any kind).
  1. Permitted activities and items. The following activities and items are not permitted within the resort, except with an authority or permit issued by the Board:
    1. Aircraft – including drones, helicopters, hang gliders, hot air balloons and parasails.
    2. Lighting and maintaining a fire, campfire or barbecue, which uses solid fuel
    3. Animals – including dogs, except for Assistance Animals
    4. Dangerous or disturbing activities
    5. Firearms, weapons and other dangerous objects
    6. Advertising, solicit or collect money, disseminate advertising or commercial or promotional material, use amplifier PA or similar device to deliver a message.
    7. Filming of a commercial nature
    8. Organised events of more than 30 persons
    9. Camping, including in tents and vehicles, or erecting a temporary structure.
    10. Interfere with animals, vegetation, rocks or similar natural objects, or cultural heritage; including cutting and taking firewood
    11. Interfere with a water course, alpine bog, water catchment area or water storage
    12. Introduction and planting of vegetation
    13. Take or introduce any material, including soil
    14. Tracked over-snow vehicles and snowmobiles
    15. Conduct commercial tours and recreational activities
    16. Powered recreational vehicles – quad bikes, side by side vehicles, motor cycles, eScooters, except registered vehicles operating on designated public roads.
  2. Recreation Activities are permitted in Set Aside Areas subject to any Conditions of Purchase of those activities delivered by the Supplier or third-party operator and any associated Conditions of Use.
  3. Consumption of alcohol is not permitted in public areas of the Resort, except in a licenced premises, event or area.
  4. Conduct and behaviour: Abusive conduct towards resort staff and other visitors will not be tolerated. All visitors are entitled to enjoy the peaceful amenity of resort and safely participate in permitted activities. Abusive and disruptive visitors will be removed from the Resort.
  5. Domestic waste is to be placed in the general waste receptacles provided around the Resort. Business, commercial, industrial and dangerous waste is not permitted in general waste receptacles.
  6. Use of public buildings – shelters, public conveniences, barbecues – shall be in accordance with the purpose of the facilities provided. Camping and overnight stays are not permitted in these facilities.
  7. Safety is a priority of the Resort. Visitors should follow the alpine responsibility code, report any incidents, report maintenance issues, and observe signage and directions. Visitors must not enter closed or unauthorised areas, including fenced and signed water catchment areas. Weather and fire danger conditions in alpine areas can change quickly at any time of the year. Visitors should be well prepared and undertake activities within their capabilities. Before entering remote or backcountry areas leave a record of your trip intentions with a responsible person. The Resort’s ski patrol provides a First Aid Response service during the Declared Snow Season. At other times of the year contact local medical providers or emergency service agencies for first aid or medical response.
  1. Visitors consent to receive and agree to pay for any medical or hospital treatment (including without limitation, ambulance transportation) which is considered in the opinion of the Supplier or its personnel to be advisable while at the Resort. Each Visitor indemnifies and will keep indemnified on demand the Supplier for all costs associated with any medical treatment required.
  2. The Supplier may at its discretion refuse entry to the Resort and remove a visitor from the Resort, if it determines, in its reasonable opinion, that a Visitor has breached any of these Conditions.
  3. The Supplier will not be liable to any Visitor for any loss or damage (including, but not limited to, indirect or consequential loss or damage, for example, but not limited to, travel and accommodation costs) suffered as a result of or arising from the closure of the Resort.
  4. A Resort Closure may be declared for any of the following reasons. During a Resort Closure visitors will not be permitted to enter or stay within the resort, and must depart as directed by Resort Management if the:
    1. Resort is required to close due to a Government Directive;
    2. Victorian Government has issued “stay at home orders” impacting the locality of the resort;
    3. Board declares, in accordance with Regulation 15 of the Alpine Resorts (Management) Regulations 2020, a closure of the resort where there is likely to be a significant danger to public safety, including on a day of Catastrophic fire danger rating.
  5. The Supplier collects personal information about Visitors attending the Resort. The Supplier may collect the name, address, phone number and email address of Visitors, as well as film, photographic and other footage, for the purposes of conducting research, marketing and promotional activities in respect of the Resort. Film and photographic footage may be used as set out in Condition 20. If the Visitor does not provide the Supplier with the personal information described above:
    • the Visitor may not be admitted to the Resort; and
    • The Supplier may not be able to provide the Visitor with information about products and services that the Guest may want, including information about discounts, sales or special promotions.
    • The Supplier may disclose the personal information it collects to its employees, related bodies corporate, contractors and service providers (including, but not limited to, research, marketing and promotional organisations). The Supplier is not likely to disclose the information to overseas recipients.
    • The Supplier’s privacy policy is available on its website (www……) and contains more details about:
      • the personal information it collects and how that information is dealt with;
      • how a Visitor may access the personal information which the Supplier holds about them and seek correction of that information; and
      • how a Visitor may complain about a breach of the Australian Privacy Principles and how the Supplier will deal with such a complaint.
  1. Alternatively, to find out more about how the Supplier collects and uses personal information, contact our Privacy Officer at ………. (who do we put here now)
  2. Unless a Visitor advises the Supplier to the contrary, the Visitor consents to receiving future promotional and marketing material from the Supplier and its related entities, including, but not limited to, via electronic messages (e.g. email, SMS etc). If a Visitor does not wish to receive promotional and marketing material, they should select the unsubscribe option where applicable or contact the Privacy Officer using the details set out in Condition 26.
  3. Visitors acknowledge and agree that any part or parts of these Conditions which contravene the law of a relevant jurisdiction and are not enforceable may be read down and are severable and do not invalidate the remaining conditions.
  4. These Conditions are governed by the laws in force from time to time in Victoria. The parties submit to the exclusive jurisdiction of the courts of Victoria.
  5. The Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (Australian Consumer Law) provides Consumers (as that term is defined in the Australian Consumer Law) with a number of protections and Consumer Guarantees that cannot be excluded or limited (Non-Excludable Rights). Other than as set out in Condition 30, these terms and conditions, and in particular any limitations of liability set out in these terms and conditions, are therefore subject to, and will not apply to the extent that they limit or exclude, such Non-Excludable Rights.
  6. Subject to Condition 31, and in addition to Condition 34, the Supplier excludes:
    1. any term, condition or warranty that may otherwise be implied into these Conditions;
    2. any liability for loss, death or personal injury incurred as a result of or in connection undertaking activities at the Resort, howsoever caused;
    3. any liability for damage to a Visitor’s property as a result of or in connection with undertaking activities at the resort howsoever caused; and
    4. any liability for indirect or consequential loss (such as loss of profits, loss of revenue and loss of opportunity).
  1. Visitors indemnify the Supplier, its personnel, contractors and any associated entities (Indemnified Parties) against all loss, liability, damage or expense incurred by any of the Indemnified Parties in connection with undertaking activities at the Resort, to the extent caused by the Permit Holder.
  2. RISK WARNING – Recreational activities including skiing, snowboarding, using ski lifts, snow tubing, tobogganing, snow play, mountain biking, and back country walking involve significant risk of physical harm including personal injury, permanent disability and / or even death and all Visitors acknowledge and voluntarily assume the risks associated with and arising from these activities. To the extent permitted by the law and in respect of any Recreational Activities, Visitor hereby release and discharge each of the Supplier, its personnel, contractors and any associated entities from all and any claims, loss, damage, costs and expense arising from any:
  1. death;
  2. physical or mental injury of an individual (including the aggravation, acceleration or recurrence of such an injury of the individual);
  3. contraction, aggravation or acceleration of a disease of an individual; or
  4. coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual that is or may be harmful or disadvantageous to the individual or community or that may result in harm or disadvantage to the individual or community, however it may be caused and even if caused by negligence or lack of due care and skill of the Supplier, its personnel, contractors and any associated entities, arising from or connected with the supply or organisation of or participation in recreational services or recreational activities, except to the extent that it is caused by the reckless conduct of the Supplier, its personnel, contractors or any associated entities. The release in this Condition 30 is intended to exclude the Permit Holders rights under Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law.

All guests booked into self-catering accommodation are required to supply their own bedding/linen etc.

Mt Baw Baw Alpine Resort recommends those travelling from interstate or abroad purchase travel insurance to cover the loss of monies in the event of unforeseen impacts to travel.
